1. FORMATION OF THE CONTRACT

1.2 No contract exists between you and us for the sale of any goods until Delightful Occasions has received and accepted your order and sends you confirmation in writing or by email to the email address you have given us. Once Delightful Occasions does so, there is a legally binding contract between us.
1.3 The contract is subject to your right of cancellation (see below) and Delightful Occasions reserves the right to refuse to accept orders from any individual or company at its absolute discretion. 1.4 We may change these terms of sale without notice to you in relation to future sales.

2. DESCRIPTION AND PRICE OF GOODS
2.1 The description and (subject to clause 2.4) the price of the goods you order will be shown on Delightful Occasions current website at the time you place your order.
2.2 All drawings, descriptive matter, specifications contained on Delightful Occasions website are published or issued for the sole purpose of giving an approximate idea of the goods described in them. They will not form part of this contract.
2.3 The goods are subject to availability. If on receipt of your order the goods you have ordered are not available from stock, We will inform you as soon as possible, and refund or re-credit you for any sum that has been paid by you or debited from your credit/debit card for the goods.
2.4 Every effort is made to ensure that prices shown on our website are accurate at the time you place your order. If an error is discovered we will inform you as soon as possible and offer you the option to either re-confirm your order at the correct price or cancel the order. If you choose to cancel, Delightful Occasions will refund or re-credit you for any sum that has been paid by you or debited from your credit/debit card for the goods.

3. PAYMENT
3.1 Payment for the goods can be made by any method shown on Delightful Occasions website at the time you place your order. Exceptions are that we do not accept cheque payment from Overseas Customers.

4. DELIVERY
4.1 The goods you order will be delivered to the address you specified in your account. If the goods are to be delivered to a different address, this must be specified at the time the order is placed and cannot be changed afterwards.
4.2 Goods are normally dispatched within 24 hours. However, Delightful Occasions will not be liable for any loss or damage suffered by you through any reasonable or unavoidable delay in delivery. In this instance, Delightful Occasions will inform you as soon as possible.

5. CANCELLATION
Under the Consumer Protection Regulations 2000 you have a statutory right to cancel your order and receive a full refund up to and including the 7th day after receipt. 5.1 If you exercise your right of cancellation after the goods have been delivered to you, you will be responsible for returning the goods to Delightful Occasions at your own cost. The goods must be returned to the address shown at 1.1 above. You must take care to ensure the goods are not damaged in the meantime, or in transit.
5.2 If for any reason you decide not to keep an item, you can return it for a refund or replacement. Non faulty items must be returned in their original packaging where appropriate and must be in an unused condition.
5.3 Once you have notified Delightful Occasions that you are cancelling the contract, Delightful Occasions will refund or re-credit you within 30 days for any sum that has been paid by you.

6. WARRANTY
6.1 If the goods Delightful Occasions deliver to you are not as ordered or are damaged, defective or of incorrect quantity, Delightful occasions liability shall be limited to replacing the damaged or defective products or if replacement goods are not available, Delightful Occasions will issue a refund. Delightful Occasions shall not be liable for failure to deliver goods ordered by you unless notified within 21 days of the date of the original order. Delightful Occasions liability will be limited to delivering the goods ordered or refunding the price and delivery charges of the non-delivered goods.
6.2 Delightful Occasions, its employees and other agents shall not be liable for any direct, indirect, special or consequential loss or damage including loss of profit or any other form of compensation. Nothing in these terms and conditions shall be construed to limit Delightful Occasions liability for death or personal injury caused by its negligence.
6.3 This does not affect your statutory rights.

7. DATA PROTECTION
7.1 Delightful Occasions will take all reasonable precautions to keep the details of your order and Payment secure, but unless Delightful Occasions is proven to have been negligent, Delightful Occasions will not be liable for unauthorized access to information supplied by you.
7.2 You can correct any information we hold about you, or ask for information about you to be deleted, by giving written notice to Delightful Occasions at the address, telephone number or email address shown at 1.1 above.

8. APPLICABLE LAW
As the internet allows access to the site from countries acting under different laws differing from those of Delightful Occasions (anywhere outside England and Wales), you agree that insofar as is allowed by any relevant legislation or jurisdiction, English Law shall govern this contract and any dispute under it.

9. COPYRIGHT
you may not reproduce, modify, copy or distribute any of the materials or contents on this website without written permission from Delightful Occasions.
We happy for you to use our step by step page to reproduce our ideas as long as you reference us. Reproductions should not be shown on any other website (including E-bay), whether for sale or not. If you wish to show a reproduction of one of our designs on an online card gallery, you must acknowledge Delightful Occasions under the picture or you will be asked to remove it. You should not claim that any of our cards are your own design or enter them into competitions or online card galleries as such.

Our pictures of cards, products and step-by-step instructions from card ideas must not be reproduced on any other website (including E-bay).
